For wholesalers with many suppliers

One record per supplier, with legality evidence across the eight areas of Article 2(40), and a list of what each supplier still owes you.

One record per supplier

A grocery or ingredients range touches many headings: palm oil (ex 1511), cocoa butter (1804), chocolate (1806), soya flour (1208 10), soya-bean oil (1507). One case holds the plots, suppliers and documents behind a statement. Check the codes you buy right here.

What each supplier still owes

Your suppliers send their plot files through a link, with no account, and you see per supplier what has arrived and what is missing. Legality records sit per producer in the eight areas of Article 2(40), next to risk and legality records for 44 countries of production.

Questions buyers ask

Each answer cites its article and links the guide that goes further.

What is a due diligence statement and when is it submitted?

It is the electronic declaration, submitted in the EU Information System before the product is placed on the market or exported, that due diligence was done and risk is negligible. It returns a reference number that goes to customs.

Art. 4, Art. 33, Art. 26(4)

Am I an operator or a trader?

The first to place a product on the EU market or to export it is an operator, anyone later is a trader unless processing creates a new relevant product. The first four digits of the customs code decide, so roasting green coffee within heading 0901 leaves a roaster a trader. Making chocolate (1806) from cocoa beans (1801) does create a new relevant product, and its maker is a downstream operator, which submits no statement either.

Commission FAQ 3.1.1, Art. 2(15b), Art. 5

Which products are covered?

Cattle, cocoa, coffee, oil palm, rubber, soya and wood, plus the derived products listed in Annex I by customs code. If a code is not in Annex I, the duty does not attach, so check the code you declare.

Annex I

Can I take plot data from my cooperative or exporter?

Yes, the Commission FAQ allows collection through cooperatives, exporters or certifiers, but you remain responsible for it being correct. Start with the cooperative's own data, screen it, and send field staff only to the plots that need it.
