Regulation (EU) 2023/1115, applying from 30 December 2026
Deforestation due diligence for every plot behind your products.
Coffee, cocoa, rubber, oil palm, soya, wood and cattle products can only be placed on the EU market with a due-diligence statement behind them. Konstata takes the plot list from your producers, screens each plot on satellite data against the EU’s own 2020 forest map, keeps the records Article 9 requires, and produces the statement per consignment.

Operators that are micro or small undertakings, established as such by 31 December 2024, have until 30 June 2027, except for timber products already covered by the old EU Timber Regulation. The obligation
What Article 9 requires you to hold, for every consignment.
The regulation does not ask for a policy. It asks for specific information on every batch you place on the market, kept for five years (Art. 12), and for a risk assessment and a statement built on it (Arts. 10 and 4). This is where each item lives in Konstata.
- The geolocation of every plot of production, as a polygon above four hectares, with the production period (Art. 9(1)(d))
- One record per plot, checked against the Information System’s rules when it is imported, screened, and dated.
- Evidence that the products are deforestation-free, against the 31 December 2020 cutoff (Art. 9(1)(g))
- A screening per plot on satellite data, with the datasets it read and the reason for the verdict written out.
- Evidence of production in accordance with the country’s laws, in eight areas from land-use rights to customs (Art. 9(1)(h), Art. 2(40))
- A legality record per producer: the documents, the category each one answers, and your justification.
- Product description, quantity, country of production, and who supplied and who bought (Art. 9(1)(a) to (f))
- Kept per case, with the producers and the plots behind each quantity.
- A risk assessment, and before placing, the due-diligence statement with its reference number (Arts. 10, 4 and 33)
- The case is where you record the assessment and sign. The statement and its reference number are kept with the quantity they cover.
Statements become due on 30 December 2026. What you build now is the record they will rest on.
Who it lands on
One regulation, four desks.
The regulation names the operator, but the work falls on several people. This is what each of them has to answer, and what Konstata does for it.
Sourcing and supplier management
Every producer must supply the geolocation of every plot and the production period, in a form the Information System accepts. Few can do it in one go, and a cooperative with hundreds of members cannot do it by email.
A link the supplier opens without an account. It takes GeoJSON, KML, spreadsheets and photographed documents, checks every geometry as it arrives, and says what is still missing. A package a supplier sends as a zip is read file by file.
Compliance, quality and sustainability
The risk assessment and the statement carry your signature, and each must rest on evidence for every plot and every producer that an authority can follow.
A screening with its reason written out, a legality record per producer across the eight categories, and a case per consignment that holds the assessment, the signature, the statement and the records for five years.
Management
Fines of at least four percent of EU turnover at the top of the scale, confiscation of the goods, and exclusion from public procurement (Art. 25). The obligation applies from 30 December 2026, and to every batch.

Logistics and customs
The statement’s reference number goes in the customs declaration for every consignment (Art. 26). Without it the goods do not clear.
The reference number is kept per case next to the quantity it covers, with the evidence behind it one click away, and the plot list exported in the Information System’s own format.
Why a generic check fails a coffee farm
On a coffee farm the tree cover is the crop. A generic check reads it as forest.
Generic checks read any loss of tree cover as deforestation, so they flag pruning and replanting. Agroforestry, where crops grow under tree cover, is outside the regulation’s definition of forest (Art. 2(6)), and the guidance says so.
Konstata weighs the crop signal, locates the loss against the 2020 forest map, and sends an unclear plot to a person with the reason written out. A small reading does not fail a plot by itself, and no plot is cleared on a missing reading.

More than one pass on every plot. WHISP under FAO’s Open Foris against the EU’s 2020 forest map, the global loss datasets and the alert layers, joined by national records where they exist. Then the loss is located against the forest map, and where the plot is still unclear, ten years of monthly satellite greenness are read for an established crop. A verdict per plot with its reasons, never milder than WHISP’s own, and a plot the data cannot settle is held for a person.
